Brisbee & Stockton provides a broad spectrum of litigation services in state and federal courts in Oregon and Washington ranging from the defense of complex commercial and professional litigation matters to defending claims arising from personal lines of insurance. Traditionally, one of the firm's primary practice areas is the defense of professional liability claims, including the defense of medical, dental, legal and veterinary malpractice claims for self-insured entities and for clients of insurance carriers. The firm also represents insurers, insureds and self-insureds in cases involving personal injury/wrongful death, premises liability, product liability, uninsured/underinsured motorist liability, insurance coverage and construction defect. Our members are also available to act as mediators and arbitrators.

In addition to representing clients in court, the firm also represents physicians, dentists, nurses and veterinarians before their respective state licensing boards in cases involving allegations of professional practice violations.

Appellate Law

Brisbee & Stockton’s appellate department boasts significant experience in handling appellate matters in Oregon and Washington’s state and federal courts, and also the Ninth Circuit Court of Appeals and the United States Supreme Court. Our appellate practice provides services for all of the firm’s practice areas, including but not limited to medical malpractice, professional liability, commercial liability, personal injury/wrongful death and construction defect. Since the firm was founded in 1951, Brisbee & Stockton has been involved in many appellate decisions that have helped to shape Oregon law. Construction Litigation

Brisbee & Stockton’s attorneys regularly defend design professionals, developers, general contractors, sub-contractors, product manufacturers and other entities in regard to claims of defective commercial and residential construction. Our services include defending these entities in the pre-lawsuit process, in binding arbitration, at trial and on appeal in all state and federal courts in Oregon and Washington. Our experience includes defending such entities in all manner of design defect claims, construction defect claims and breach of contract claims.

Dental Malpractice Defense

Insurance Coverage

Brisbee & Stockton’s attorneys have a wealth of experience in counseling insurers on various aspects of insurance coverage, including but not limited to duty to defend, duty to indemnify and bad faith. The firm is approved counsel for a number of major insurance and claims administration companies, and regularly assists those entities and others by providing coverage opinions, exposure evaluation, and defense of insurance coverage and bad faith lawsuits.

Legal Malpractice Defense

Brisbee & Stockton’s lawyers have decades of experience defending law firms and lawyers in all aspects of legal malpractice actions. We regularly work with Oregon’s Professional Liability Fund in defending Oregon lawyers and law firms in all aspects of legal malpractice litigation, including claims for legal malpractice, third-party claims and malicious prosecution, and on motions for sanctions or disqualification. We are also regularly hired by the PLF to serve as “repair” counsel, getting involved in actions to assist in correcting matters so as to avoid a malpractice action against a particular lawyer or law firm. Additionally, our lawyers are frequently hired to assist or represent lawyers facing charges of misconduct by the Oregon State Bar.
